2. Application and acceptance of these Terms
These Terms govern access to the website, the viewing and use of festival content, use of the contact form, newsletter subscriptions and other website functions. By using the website, you confirm that you have read and accept these Terms. Nothing in these Terms excludes statutory rights that cannot legally be limited.
3. Purpose of the website
The website provides information about the International Festival of Fine Arts Kranj, its programme, artists, curators, venues, partners, news, open calls and media content. We publish and update the information with reasonable care.
Additional terms may apply to ticket purchases, reservations, event registrations, competitions, open calls or other special activities. Such additional terms are published with the relevant service and take precedence over these general Terms for that service.
4. Programme changes and cancellations
For artistic, organisational, safety, weather, health or other justified reasons, we may change the programme, participants, time, venue or method of delivery, or postpone or cancel an event. We publish changes as soon as reasonably possible. Refunds for paid events are governed by the applicable sales terms and mandatory law.
5. Permitted and prohibited use
You may use the website for lawful, personal and non-commercial information purposes. In particular, you must not:
- interfere with the operation, security, servers or networks of the website;
- use automated bulk extraction, impose an unreasonable load or bypass technical restrictions;
- introduce malicious code, carry out unauthorised vulnerability testing or attempt unauthorised access;
- use content in a way that infringes copyright, personality, data protection or other rights;
- misrepresent your identity or your connection with the association, festival, an artist or a partner;
- use published contact details for unsolicited advertising or bulk messaging.
6. Copyright and other rights
Texts, visual identity, logos, photographs, videos, reproductions of artworks, catalogues, databases and other content are protected by copyright, related rights, personality rights or other rights belonging to the association, artists, photographers, designers, partners or other rights holders.
You may view the content, make temporary technical copies, print an individual page for personal use and share a link to the original page. Any other reproduction, adaptation, publication, distribution, commercial use or removal of authorship notices requires the prior permission of the relevant rights holder unless the law provides otherwise. Naming the author and source does not replace permission.
7. User-submitted materials
If you send us text, a photograph, application, biography, logo or other material, you confirm that you are entitled to provide it and that its use for the agreed purpose will not infringe third-party rights. The scope of permission for public use is set out in the relevant agreement, call or contract. We may decline to publish content that is unlawful, offensive, misleading, technically harmful or clearly unrelated to the festival.
8. Contact form and electronic communication
The contact form is intended for questions about the festival, programme, cooperation, media activities and accessibility. Users must provide accurate information and must not include unnecessary sensitive data, malicious content or material that infringes third-party rights. We reply to received messages within a reasonable time.
9. Newsletters
You may subscribe to newsletters with a valid email address and freely given consent. The subscription is confirmed through a double opt-in process. Every message includes a simple and free method of unsubscribing. Subscribing another person without their permission is prohibited. Personal data processing is explained in greater detail in the Privacy Policy.
10. External links and services
The website contains links and technical resources provided by third parties, including maps, social networks, media publications and partner websites. Their operators are responsible for their content, availability and personal data processing, and their terms apply. We provide external links for convenience or source attribution.
11. Availability and security
We maintain the website with reasonable professional care and apply appropriate security measures. Access may be temporarily restricted for maintenance, improvements, security events or circumstances outside our reasonable control. Users are responsible for protecting their own devices, software and connections.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect loss, loss of data, loss of use or the consequences of decisions made solely on the basis of general website information. This limitation does not apply to loss caused intentionally or through gross negligence, personal injury, or cases in which liability cannot legally be excluded or limited.
13. Privacy, cookies and accessibility
Personal data processing is governed by the Privacy Policy, the use of cookies by the Cookie Policy, and accessibility information by the Accessibility Statement. All documents are permanently and easily accessible in the website footer.
14. Breaches of these Terms
Where misuse is reasonably suspected, we take lawful, necessary and proportionate measures to protect the website, users and third parties, including restricting access, preserving evidence and notifying the competent authorities.
15. Changes to these Terms
We update these Terms when services, the programme, technology or legislation change. A new version applies from the date stated at the top. Legal relationships already formed remain governed by the Terms applicable when they arose unless the law or an agreement provides otherwise.
16. Governing law and dispute resolution
The law of the Republic of Slovenia applies. We seek to resolve disputes amicably. If this is not possible, the court in Kranj with subject-matter jurisdiction is competent, unless mandatory provisions, particularly consumer protection rules, provide for another jurisdiction.
